Second Pilot Terms of Service

Effective Date: October 3, 2026
Last Updated: October 3, 2026

Please read these Terms of Service (“Terms”) carefully. They explain how Second Pilot works, what you can expect from us, what we expect from you, and how disputes are handled.

By creating or using a Second Pilot account, participating in a household assessment, purchasing Second Pilot services, or using the Service in another authorized way, you agree to these Terms. If you do not agree, do not use the Service.

1. Who We Are

The service is operated by Second Pilot (“Second Pilot,” “we,” “us,” or “our”), a California-based sole proprietorship.

2. What Second Pilot Does

Second Pilot is a household-continuity assessment and planning service.

Two household participants independently provide information about how important household responsibilities are understood and managed. Second Pilot compares that information to identify strengths, knowledge gaps, dependencies, and potential single points of failure.

Depending on the service purchased, Second Pilot may provide a Household Continuity Score, Household Continuity Report, 30-Day Knowledge Transfer Plan, and other household-continuity tools.

Second Pilot uses automated and AI-assisted processes to analyze information and prepare results. During beta and in appropriate circumstances, results may also undergo automated quality checks or limited human review.

Second Pilot is not:

  • financial, investment, tax, legal, medical, or estate-planning advice;
  • a substitute for advice from an appropriately qualified professional; or
  • a vault or repository for passwords, PINs, Social Security numbers, full account numbers, or similar highly sensitive credentials.

Please do not provide passwords, PINs, Social Security numbers, full account numbers, or other credentials that Second Pilot does not request.

Second Pilot is intended to help households identify continuity gaps and create a practical path for addressing them. It does not guarantee that every risk, responsibility, document, account, or household issue will be identified.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a contract to use Second Pilot.

By using the Service, you represent that you meet these requirements.

4. Accounts and Household Assessments

A Second Pilot household assessment generally involves two independently participating adults.

Each participant is responsible for providing information based on their own knowledge, access, ability, and understanding.

Participants should provide accurate account information and maintain control of their individual Second Pilot sign-in access. Second Pilot uses individual verified identities; users should not share secure sign-in links or otherwise allow another person to use their identity.

For Professional-sponsored assessments, a purchased household unit becomes used according to the activation rules displayed by Second Pilot. Cancellation or expiration before activation may return an eligible unit to the Professional Organization’s available inventory according to the applicable product rules.

Once activated, the household controls its participation in the assessment, subject to these Terms and applicable Second Pilot policies.

5. Household Privacy and Results

Participants provide their information independently.

Second Pilot does not ordinarily disclose one participant’s individual responses to the other participant, a sponsoring Professional, or a Professional Organization.

Household results may combine information from both participants to identify shared findings, differences in knowledge or readiness, and continuity gaps.

A Professional who sponsors or assists with an assessment does not automatically receive access to the household’s Report or 30-Day Knowledge Transfer Plan.

If Professional access is offered through Second Pilot, both household participants must affirmatively authorize the specific Professional before that Professional can view those results through the Professional Portal.

Professional Organization administrators or principals do not automatically inherit that permission.

Households may download and share their own published results with family members, friends, advisers, professionals, or others of their choosing.

6. Fees, Purchases and Refunds

Certain Second Pilot services require payment. Prices, minimum purchase requirements, promotional offers, and included services are displayed at the time of purchase.

All prices are stated in U.S. dollars unless otherwise indicated.

Professional Organizations may purchase household units for assignment to client households. Second Pilot does not control or manage any separate fee a Professional Organization may charge its clients.

Second Pilot does not provide an automatic right to a refund of purchased Professional units.

If you believe a charge was made incorrectly or wish to request a refund, contact:

Support@SecondPilotPlan.com

Refund requests are evaluated individually. If Second Pilot approves a refund, it will be processed through the applicable payment system.

Second Pilot may change future pricing and promotional offers. A pricing change does not alter units or services already purchased unless expressly stated otherwise.

Applicable taxes may be added when required by law.

7. Professional Organizations and Professionals

Professional Organizations and their authorized users must use Second Pilot only within the permissions assigned to them.

A Professional may receive operational information necessary to manage assigned households, such as assessment status and activity, without receiving access to participants’ private responses.

Professionals are responsible for their own professional, ethical, regulatory, licensing, tax, billing, recordkeeping, and client-relationship obligations.

Second Pilot results are informational household-continuity tools and do not replace a Professional’s independent judgment or professional advice.

Professional Organizations are responsible for maintaining accurate information about their authorized Account Principal, Administrators, Professionals, and organization contact information.

8. Automated Analysis, Quality Review and Clarification

Second Pilot uses automated and AI-assisted systems to analyze household information and generate findings and planning materials.

Second Pilot may request additional clarification from a participant when information is ambiguous or insufficient to support a reliable finding.

Differences between participants are not necessarily errors. They may themselves represent meaningful household-continuity findings.

When a matter cannot reasonably be resolved from the information available, Second Pilot may identify the result as “Unable to determine” rather than infer or manufacture certainty.

During beta and as part of ongoing quality assurance, Second Pilot may use automated quality review and limited human review to evaluate the reliability and consistency of generated results.

9. Support and Protected Access

Second Pilot personnel do not ordinarily review individual participant responses as part of routine account administration.

When necessary to investigate a specific support, technical, analysis, security, or system problem, an authorized Second Pilot Platform Administrator may use controlled Protected Support Access to review information reasonably necessary to diagnose the issue.

Protected Support Access is limited, deliberate, read-only, and audit logged. It is not used as routine access to household information.

Second Pilot may use information obtained through an authorized support investigation to diagnose and correct the Service, regenerate affected outputs when appropriate, and maintain system reliability.

10. Acceptable Use

You agree not to:

  • use Second Pilot for unlawful purposes;
  • access or attempt to access another person’s, household’s, Professional’s, or organization’s information without authorization;
  • interfere with or circumvent Second Pilot’s security or access controls;
  • reverse-engineer, scrape, copy, or attempt to extract protected Second Pilot software, methodology, scoring systems, or proprietary processes;
  • introduce malicious code or intentionally interfere with operation of the Service; or
  • provide passwords, PINs, Social Security numbers, full account numbers, or other highly sensitive credentials that Second Pilot does not request.

11. Intellectual Property and Household Materials

Second Pilot’s software, methodology, analysis framework, scoring approach, designs, branding, and other proprietary technology and materials are owned by Second Pilot or its licensors and are protected by applicable intellectual-property laws.

Using Second Pilot does not transfer ownership of Second Pilot’s proprietary technology or methodology to you.

Households retain the right to use, download, print, and share the Reports, Plans, and other household outputs provided to them, subject to any applicable third-party rights and these Terms.

12. Service Availability and Disclaimer of Warranties

Second Pilot is provided “as is” and “as available.”

To the extent permitted by law, Second Pilot disclaims express and implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will always be uninterrupted or error-free, or that every household issue or continuity risk will be identified.

Beta features may change as Second Pilot is tested and improved.

13. Limitation of Liability

To the fullest extent permitted by law, Second Pilot and its owner will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, income, profits, business opportunity, or goodwill arising from use of or inability to use the Service.

To the extent permitted by law, Second Pilot’s aggregate liability for claims relating to the Service will not exceed the amount paid directly to Second Pilot by the claimant during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold Second Pilot harmless from claims, damages, liabilities, and reasonable expenses arising from your unlawful use of the Service, misuse of the Service, or material violation of these Terms.

15. Dispute Resolution — Binding Arbitration

This section affects legal rights and should be reviewed carefully.

Any dispute arising out of or relating to these Terms or the Second Pilot service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules in effect at the time the claim is filed. Judgment on the award may be entered in any court with jurisdiction.

Arbitration will be conducted in Sacramento County, California, another mutually agreed location, or remotely where appropriate.

Before initiating arbitration, the parties agree to make a reasonable good-faith effort to resolve the dispute informally.

To the extent legally enforceable, disputes must be brought individually and not as part of a class, consolidated, or representative action.

This arbitration provision survives termination of the account or these Terms.

16. Governing Law

These Terms are governed by California law, without regard to conflict-of-law principles, except where federal law—including the Federal Arbitration Act—applies.

17. Suspension and Termination

Second Pilot may suspend or terminate access when reasonably necessary to address a material violation of these Terms, unlawful activity, abuse, fraud, security risk, or threats to the Service or other users.

Users may stop using Second Pilot at any time.

Household withdrawal, account closure, and requests concerning deletion of personal information are handled according to the applicable Second Pilot product and privacy procedures.

18. Changes to These Terms

Second Pilot may update these Terms as the Service evolves, including during and after beta.

We will update the Last Updated date when changes are made. For material changes affecting active users, Second Pilot will provide reasonable notice when required or appropriate.

Continued use after revised Terms take effect constitutes acceptance where permitted by law.
